1. Acceptance of Terms

By creating an account or using Brainstorm Buddie, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Description of Service

Brainstorm Buddie is an AI-powered business planning platform that generates reports, pitch decks, and strategic analysis based on user-provided business ideas. All content is generated algorithmically and delivered digitally.

3. Subscription & Billing

3.1 Plans & Pricing

  • Free Tier: Limited features, no charge
  • Pro Tier: $19/month or $190/year
  • Premium Tier: $49/month or $490/year
  • Premier Tier: $79/month or $790/year

3.2 Automatic Renewal

Paid subscriptions automatically renew unless canceled at least 24 hours before the renewal date. You may cancel anytime through your account settings.

3.3 Price Changes

We reserve the right to modify pricing with 30 days notice. Existing subscribers will be notified via email before any price increase takes effect.

4. Digital Goods & Refund Policy

4.1 Nature of Service

All reports, pitch decks, and AI-generated content are digital goods delivered instantly upon generation. By initiating report generation, you acknowledge that:

  • The service is rendered immediately
  • Digital content cannot be “returned”
  • You are purchasing access to AI-generated analysis, not guaranteed business outcomes

4.2 Successful Delivery Defined

A report or digital product is considered “successfully delivered” when ANY of the following occur:

  • The report appears in your project dashboard
  • The report content is displayed on screen
  • The report is available for download or export
  • Our system logs confirm generation completed without error

4.3 No Refunds for Successfully Delivered Content

Once digital content has been successfully delivered, no refunds will be issued. This includes situations where:

  • You are dissatisfied with the AI's analysis or recommendations
  • You believe the content is not useful for your purposes
  • You change your mind after generation
  • You did not read or use the report
  • Your business idea changed after report generation

4.4 Refund-Eligible Situations

Refunds ARE available for:

  • Technical failure: Report generation failed due to system error (not user error)
  • Duplicate charges: Accidental double-billing for the same transaction
  • Service unavailability: Extended outage (>24 hours) preventing access to paid features
  • Billing error: Charged incorrect amount or charged after cancellation

4.5 Refund Request Process

To request an eligible refund:

  • Submit request within 7 days of the charge
  • Email support@brainstormbuddie.com with transaction ID
  • Include description of the technical issue
  • We will investigate and respond within 5 business days

4.6 Subscription Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You retain access until the end of your current billing period
  • No partial refunds for unused time
  • Generated reports remain accessible on the Free tier

5. Usage Tracking & Dispute Resolution

5.1 Activity Logging

We maintain comprehensive logs of:

  • Report generation events (timestamp, user ID, project ID)
  • Content access and viewing events
  • Download and export events
  • Account activity and login history

These logs serve as evidence of service delivery in the event of disputes.

5.2 Chargeback Policy

If you initiate a chargeback or payment dispute with your bank or credit card company for a legitimately delivered service:

  • Your account will be immediately suspended
  • Access to all generated content will be revoked
  • We reserve the right to pursue recovery of funds plus administrative fees
  • Your information may be shared with fraud prevention services

5.3 Dispute Resolution

Before initiating a chargeback, you agree to:

  • Contact us directly at support@brainstormbuddie.com
  • Allow 5 business days for investigation
  • Provide relevant details about your concern

We are committed to resolving legitimate issues fairly and promptly.

6. Acceptable Use

6.1 You Agree NOT To:

  • Use the service for illegal purposes
  • Attempt to reverse-engineer the AI systems
  • Share account credentials
  • Resell or redistribute generated content as a competing service
  • Submit fraudulent refund requests
  • Abuse the support system with repeated baseless complaints

6.2 Account Termination

We reserve the right to terminate accounts that violate these terms, with or without notice. No refunds will be issued for terminated accounts.

7. Intellectual Property

7.1 Your Content

You retain ownership of your business ideas and information you provide. You grant us license to process this information to deliver the service.

7.2 Generated Content

Reports and content generated for you are yours to use for your business purposes. You may not claim the AI-generated content as human-written work.

7.3 Our Platform

The Brainstorm Buddie platform, branding, and underlying technology remain our intellectual property.

8. Disclaimers

8.1 No Guaranteed Outcomes

AI-generated reports are for informational purposes only. We do not guarantee:

  • Business success or profitability
  • Accuracy of market size estimates or financial projections
  • That recommendations are suitable for your specific situation

8.2 Not Professional Advice

Our service does not constitute legal, financial, tax, or professional advice. Consult qualified professionals before making business decisions.

8.3 AI Limitations

AI-generated content may contain errors, outdated information, or analysis that doesn't account for your unique circumstances. You are responsible for verifying information before acting on it.

9. Limitation of Liability

To the maximum extent permitted by law, Brainstorm Buddie shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits or business opportunities
  • Decisions made based on generated content
  • Total liability exceeding the amount you paid in the 12 months preceding the claim

10. Modifications to Terms

We may update these terms at any time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Delaware for the resolution of any disputes.
